Terms & Conditions

1. Acceptance and scope
These Terms and Conditions govern your use of this website and any inquiry you submit through it. By using the website, you agree to these Terms. If you engage me for pilot services, the signed agreement for that engagement will also apply. If these Terms and a signed agreement conflict regarding an engagement, the signed agreement controls, subject to applicable law and aviation regulations.
This website advertises the availability of a pilot for lawful engagements. It does not book or sell air transportation.

2. Pilot services only; no charter offering
I offer my services as a commercial pilot, subject to my certificates, ratings, qualifications, currency, availability, insurance requirements, and the rules applicable to each proposed operation.
I do not offer charter flights, seats, air transportation, or an aircraft with a pilot through this website. I do not hold an FAA air carrier or commercial operator certificate by virtue of holding a commercial pilot certificate. An inquiry, quote, payment, or pilot services agreement does not authorize a flight that requires operating authority the responsible operator does not possess.
My commercial pilot certificate permits compensated pilot work only when I am qualified and the entire operation complies with applicable requirements. No statement on this website guarantees that a proposed trip can legally be conducted under 14 CFR Part 91.

3. Aircraft and operational control
For an engagement advertised through this website, the client must independently own, or have a lawful right to use, the aircraft and must identify the person or entity responsible for its operation. The responsible operator must exercise actual operational control, including authority over initiating, conducting, and terminating the operation and the responsibilities assigned to it by law.
I do not supply an aircraft as part of my pilot services. I do not arrange an aircraft rental or lease for a prospective passenger, sell access to an aircraft, bundle aircraft and pilot charges, or require a client to obtain an aircraft from a particular owner or lessor. I will not participate in an arrangement that appears to use separate aircraft and pilot agreements to disguise an unauthorized charter operation.
Calling an agreement a “dry lease,” naming a client as the operator, or paying the aircraft provider and pilot separately does not, by itself, establish lawful operational control. The parties’ actual conduct and responsibilities must support the proposed arrangement.

4. Inquiries and acceptance of work
Submitting an inquiry does not create a pilot engagement, reserve a flight, or guarantee that I will accept an assignment. Before accepting work, I may request information about the aircraft, its owner or lessor, the proposed operator, the purpose of the flight, the people or property to be carried, the applicable operating rules, insurance, aircraft records, and any required authorizations.
I may decline, postpone, or end discussions about an engagement if its legality, operational control, aircraft suitability, insurance, or safety cannot be established to my satisfaction. Neither these Terms nor a quote obligates me to act as pilot in command of any flight.

5. Client and operator responsibilities
The client and responsible operator are responsible for providing accurate information and for fulfilling their legal and contractual duties concerning the aircraft and operation. Those duties may include establishing lawful aircraft possession or use; maintaining required registration, airworthiness, inspections, records, and equipment; obtaining applicable insurance and permissions; and complying with any operating certificate, operations specifications, lease requirements, or other rules that apply.
The client must disclose any aircraft discrepancy, operational restriction, insurance requirement, or other fact that could affect the proposed engagement. The client may not represent that I, this website, or a pilot services agreement supplies charter authority or makes an otherwise unauthorized flight permissible.
Allocation of responsibilities in a private contract does not override responsibilities imposed by law on the operator or pilot in command.

6. Pilot qualifications and flight decisions
I will accept an assignment only if I determine that I hold the certificates, ratings, endorsements, medical qualification, currency, and other qualifications required for my role and the proposed operation. Additional aircraft, insurer, operator, or regulatory requirements may apply.
When serving as pilot in command, I retain the authority and responsibility assigned to the pilot in command by applicable law. I may delay, divert, refuse, or terminate a flight when I determine it is necessary for safety or compliance. A client’s schedule, request, or payment does not override that judgment.
All flights remain subject to weather, aircraft condition, performance, weight and balance, fuel, airspace, airport conditions, crew fitness, and other applicable considerations. No route, departure time, arrival time, or completion of a flight is guaranteed.

7. Permitted types of engagements
Depending on the facts and applicable rules, potential engagements may include piloting an aircraft for its owner or lawful operator, aircraft repositioning or ferry work, and other assignments permitted by my qualifications and the authority under which the aircraft is operated. Describing a category of work on this website does not mean every proposed flight in that category is lawful or that I am qualified or available for it.
I do not offer flight instruction or instructor endorsements unless I separately hold the required instructor privileges and expressly agree in writing to provide those services. The presence of a flight instructor on a trip does not automatically turn transportation into instruction or eliminate requirements that otherwise apply to the operation.

8. Quotes, fees, and expenses
Any quote is for pilot services described in writing and is subject to review of the proposed operation. A pilot fee is separate from the cost of obtaining or operating an aircraft. Unless a signed agreement expressly says otherwise, the client or responsible operator pays aircraft rental or lease charges, fuel, landing and parking fees, maintenance, and other aircraft operating costs directly to the appropriate provider.
A signed pilot services agreement will specify the applicable pilot fee, reimbursable pilot expenses, payment timing, cancellation terms, and any travel or overnight arrangements. No website inquiry or displayed estimate is a binding price or confirmed booking.

9. Changes, cancellations, and unsafe or unlawful requests
A proposed flight may be changed or cancelled because of weather, aircraft condition, regulatory requirements, a change in the proposed operation, unavailable records, pilot fitness, or other safety or compliance concerns. Any fee or expense consequences will be governed by the signed agreement and applicable law.
I will not knowingly undertake an operation that requires an air carrier or commercial operator certificate or other authority that the responsible operator lacks. I may request clarification or documentation before deciding whether to accept or continue an assignment.

10. Website information and credentials
The website provides general information about my background and availability. Aviation rules and my qualifications may change, and website content may not reflect a recent change. Credentials, ratings, experience, and availability should be confirmed directly before an engagement. Website content is not an FAA authorization, legal opinion, aircraft airworthiness determination, or flight release.
Links to third-party websites are provided for convenience. I do not control their content or adopt their statements merely by linking to them.

11. Communications and information submitted
You agree to provide accurate contact and engagement information. Do not submit sensitive personal, medical, payment-card, or security information through a general website form.
I may use the information you submit to respond to your inquiry, evaluate a proposed engagement, and communicate about requested services. Any separate Privacy Policy describes the website’s handling of personal information in greater detail. Submitting an inquiry does not authorize marketing messages beyond those permitted by applicable law or any consent you separately provide.

12. Website use and intellectual property
You may use this website to learn about my services and make legitimate inquiries. You may not interfere with its operation, submit false or misleading requests, attempt unauthorized access, or use its content to misrepresent my services or qualifications.
Unless otherwise indicated, the text, branding, photographs, and other original website content belong to me or are used with permission. You may not reuse them for commercial purposes without written permission.

13. Disclaimer and limitation of liability
The website is provided for general informational purposes. I make reasonable efforts to keep it accurate, but I do not warrant that it will always be available, current, or free of errors.
To the extent permitted by applicable law, I am not liable for losses arising solely from your reliance on website content or from website interruptions. Any allocation or limitation of liability concerning actual pilot services must be addressed in the signed engagement agreement. Nothing in these Terms limits liability or duties where doing so is prohibited by law, and nothing reduces a pilot’s or operator’s regulatory responsibilities.

14. Changes to these Terms
I may update these Terms by posting a revised version and effective date on the website. Updated Terms apply to website use after posting. They do not retroactively change a signed pilot services agreement unless the parties agree in writing.

15. Governing law and severability
To the extent state law governs these website Terms, Alabama law applies, without overriding applicable federal aviation law. If a provision is unenforceable, the remaining provisions remain in effect to the extent lawful. These Terms do not grant authority to conduct any flight.
